Terms of use

The rules for using evenentry.com, its guides and posts, and its forms.

The short version

  • These terms cover the evenentry.com site; work on a client's store is under its own signed agreement.
  • Our guides and posts are general information, not legal or tax advice, and we provide them as is.
  • Wyoming law governs these terms.
  • You keep any rights that the law where you live protects from removal by agreement.

Agreement to these terms

Even Entry LLC ("Even Entry," "we," "us," or "our") runs the website at evenentry.com (the "site").

These terms of use (the "terms") govern your use of the site: its pages, guides, blog posts and feeds, and its call and contact forms.

The site is for businesses: for people who run or work for online stores, and for their developers and lawyers.

Our work on a client's store is governed by a separate written agreement that the client and we both sign. Where that agreement differs from these terms, that agreement controls.

These terms apply to anyone who uses the site and knows these terms are there.

You accept these terms when you book a call or send us a message. Each form says so beside its button, before you press it.

You must be at least 18 years old to use the site. If you use it for a business, you agree to these terms for yourself and that business, and confirm you have authority to bind it.

Using the site

You may read, print and share any page. You may quote short passages of our guides and posts, with a link back to the page. You may also follow our feeds.

We may change, suspend or discontinue the site, or any part of it, at any time.

When you use the site, you agree to the following.

  • Do not attempt to damage or overload the site, or to bypass its security.
  • Do not use our logo, or suggest that we endorse you or your store, without our written permission.
  • Do not copy our pages, guides or posts to republish them, beyond short quotations with a link back to the page.

Intellectual property

Our name, our logo, and the original text and illustrations on the site belong to us.

Quotations belong to their authors, and each one names its source. Laws and US government pages are in the public domain.

We reserve all rights that these terms do not grant to you.

Feedback. If you send us suggestions about the site or our services, we may use them freely, without paying or naming you. This applies only to suggestions, not to what you tell us about your store.

Trademarks

The names in the notices below belong to their owners.

We show the logos of the platforms below to name the platforms we work on. We are independent of each of them, and none of them endorses, sponsors or approves of us.

  • WooCommerce and its associated designs are trademarks of Automattic Inc.
  • Shopify and the Shopify logo, the shopping bag with an "S", are registered trademarks of Shopify Inc. or its affiliates.
  • Webflow and its logos are trademarks of Webflow, Inc.
  • BigCommerce is a registered trademark of BigCommerce Pty. Ltd.

Credits and licenses

Our test store is a Shopify store that we own, presented as a fictional clothing brand. Its product photos come from Shopify's sample clothing catalog.

The site is set in Atkinson Hyperlegible Next and Signika, under the SIL Open Font License. Its icons are Phosphor's, under the MIT License.

Guides and posts

Our guides and posts provide general information about accessibility and the law. They are not tailored to any particular store. Each one gives its sources.

Each guide shows the date we last reviewed it. Under its sources, each post shows the date we last read each source. Laws and court decisions can change after those dates.

We do not give legal advice. If you have received a demand letter, ask your lawyer.

Our guides and posts are not tax advice or a substitute for a lawyer's advice. For tax, ask a tax preparer.

Reading them, or having a call with us, does not make us your lawyer or your tax adviser.

Prices

Every price on the site is in US dollars, before any tax.

A plan's monthly price covers one Shopify or WooCommerce storefront in one language, with up to 1,000 pages and up to 25 third-party apps.

Your price is the one in the written quote or agreement we send you. It is higher than the plan's price if your store has more pages or apps than the plan covers, or if it has another storefront. It is also higher if your store is built another way, or if you choose an add-on, and the quote names each reason.

Our pricing page explains what moves the price.

You learn your price before you sign anything.

Booking a call

We offer a free 30-minute video call on Google Meet.

Booking a call commits you to nothing; after the call, you decide.

Corrections

We work to keep the site accurate, and we say where a point is not settled.

To report a mistake, write to hello@evenentry.com. A person reads and answers every message.

If part of the site does not work for you, our accessibility statement explains how to tell us.

Your personal information

Our privacy policy explains what we collect and how we use it.

We keep and use what you send through the call and contact forms as that policy describes.

Where these terms and the privacy policy differ about personal information, the privacy policy applies.

Others publish the laws, standards and reports we link to, on sites we do not control. We are not responsible for what those sites say or for changes to them.

Disclaimers

We provide the site, its guides and its posts "as is."

We do not promise that they are accurate, complete, current, free of errors or suitable for your purpose.

We also do not promise that the site will always be available or free of viruses.

Do not base a business decision on the site, its guides or its posts alone.

We do not promise that a store will not be sued.

Limitation of liability

The site, its guides and its posts are provided free of charge.

We are not liable to anyone for any loss arising from using or relying on them. Such loss includes lost sales, legal costs and what a demand letter or a lawsuit against your store costs you.

If a court nevertheless finds us liable, our total liability for the site is limited to US$100.

Nothing in these terms limits our liability for any of the following.

  • Death or personal injury caused by our negligence.
  • Fraud, or a statement we knew to be untrue.
  • Harm we caused intentionally or recklessly.

Indemnification

This section applies to a claim against us that arises because you breached these terms, or broke the law in using the site. You agree to cover our reasonable costs of that claim, including lawyers' fees.

Termination

We may suspend or terminate your access to the site if you breach these terms.

Governing law and disputes

Wyoming law governs these terms and any dispute about the site, without regard to Wyoming's conflict-of-law principles.

Disputes will be heard by the state courts in Sheridan County, Wyoming, or the federal court for the District of Wyoming.

If the law where you live gives you rights that no agreement can remove, you keep them. If that law lets you bring a claim in the courts where you live, you may still do so.

General

  • Electronic communications. By writing to us or booking a call, you agree that we may reply and send you notices by email. You also agree that email counts as writing.
  • Severability. If a court rules part of these terms unenforceable, the rest of these terms still applies.
  • No waiver. If we delay enforcing a term, we do not give up our right to enforce it.
  • Assignment. You may not transfer these terms to anyone else without our written agreement. We may transfer them to a business that takes over the site.
  • Entire agreement. These terms are the entire agreement between you and us about the site.

Changes to these terms

We update these terms when the site, our services or the law change.

The date at the top of this page shows when they last changed. The list at the end shows what changed.

A change applies from its date, not before. Anything you did under an earlier version, such as booking a call or sending a message, stays under that version.

Each earlier version remains on its own page, word for word.
